Terms of Use

1. Acceptance

These Terms of Use (“Terms”) apply to GPS Site Camera: Stamp, including the Android application identified by com.geostamp.gpscamera and the corresponding iOS application (the “App”). The App is provided by Vishal Bhimporwala (“we,” “us,” or “our”).

By downloading, accessing, purchasing through, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. License and permitted use

Subject to these Terms and the applicable app-store rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for lawful site-documentation and related purposes.

You receive a license to use the App, not ownership of the App or its software, designs, branding, or other intellectual property.

3. Your responsibilities

• Use the camera, microphone, location, and sharing features only where you have the legal right and any required consent.
• Follow workplace, property, privacy, surveillance, safety, and record-keeping rules that apply to you.
• Review stamps, coordinates, addresses, dates, times, maps, reports, and exported files before using or sharing them.
• Keep suitable backups and preserve original files when authenticity, auditability, or evidence may matter.
• Protect your device and do not use the App in a way that distracts you while driving, operating equipment, or working in a hazardous area.

4. Captures and user content

You retain your rights in photos, videos, text, reports, and other content you create with the App. You are responsible for that content and for deciding where it is saved or shared.

The App stores captures locally by default. When you export or share content, the selected destination and its terms and privacy practices apply. We are not responsible for third-party recipients, cloud backups, galleries, file providers, or sharing applications.

5. Location, map, and stamp accuracy

Location and stamp output can be affected by device hardware, satellite visibility, network availability, operating-system services, permissions, map providers, geocoding providers, clock settings, and user-entered information.

6. Premium purchases and subscriptions

• Premium products, prices, billing periods, trials, and available features are shown in the App and in the applicable store before purchase.
• Monthly and yearly subscriptions automatically renew unless canceled before the next billing date. The store account used for purchase is charged according to the displayed terms.
• You can manage or cancel a subscription through the applicable app-store account. Deleting the App does not cancel a subscription.
• After cancellation, paid access generally continues until the end of the current paid period, subject to store rules.
• Refunds, taxes, payment processing, billing disputes, and trial eligibility are governed by the applicable store and mandatory local law.
• If a lifetime product is offered, it is a one-time purchase associated with the purchasing store account and supported App.
• Restore Purchase checks eligible purchases associated with the current store account. Availability can depend on the store, network, account, and product status.

7. Advertising and rewarded access

Eligible free users may see app-open, native, banner, or interstitial advertising at configured locations or action boundaries. Advertising availability and frequency may vary by device, region, consent status, premium status, and remote configuration.

Rewarded ads are optional and begin only after you choose the rewarded-ad option. A successfully completed rewarded ad may unlock an eligible premium feature for the current app session. Session access is temporary, has no cash value, is not transferable, and may end when the App is closed or restarted.

8. Third-party services

The App may use services supplied by Google, Apple, mapping or geocoding providers, Google Play Billing, Google Mobile Ads, Google User Messaging Platform, Firebase Remote Config, Firebase Analytics, and Firebase Crashlytics. Those services may be unavailable, changed, or governed by separate terms and privacy policies.

9. Prohibited conduct

You must not:

• Use the App unlawfully, invasively, deceptively, or to violate another person’s rights.
• Remove ownership notices, bypass premium or advertising controls, interfere with security, or misuse store purchase systems.
• Reverse engineer, copy, modify, distribute, resell, rent, or create derivative works from the App except where applicable law expressly permits it.
• Introduce malware, automate abusive requests, disrupt the App or third-party services, or attempt unauthorized access.
• Misrepresent a stamp or report as independently certified, tamper-proof, or guaranteed evidence.

10. Availability, updates, and termination

We may add, change, suspend, or discontinue features, supported platforms, ads, premium products, or third-party integrations. Updates may be required for security, compatibility, billing, or continued service access.

We may suspend or terminate access where reasonably necessary to address unlawful use, abuse, security risk, store requirements, or a material breach of these Terms. Provisions that by their nature should survive termination will remain effective.

11. Disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, merchantability, non-infringement, evidence admissibility, or compatibility with every device or service.

Nothing in these Terms excludes guarantees or rights that cannot legally be excluded under applicable consumer law.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost data, content, revenue, profits, business opportunity, or reputation arising from use of or inability to use the App.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. This section does not limit liability that cannot legally be limited.

13. Applicable law and store terms

These Terms are governed by applicable law, without removing mandatory consumer rights available in your place of residence. Any dispute must be brought before a court or forum with lawful jurisdiction.

The applicable app store’s terms also apply. If those terms conflict with these Terms for store-controlled billing, distribution, or licensing matters, the store terms control to the extent required.

14. Changes to these Terms

We may update these Terms when features, business practices, store requirements, or laws change. The updated version will be posted at the same public URL with a revised effective date. Continued use after an update means you accept the revised Terms where permitted by law.
